28. Insurance in the “title insurance” class is insurance whereby the insurer undertakes to indemnify the insured against loss or damage resulting from(1) the existence of a hypothec, a prior claim, a servitude or any other restriction on the right of ownership of property;
(2) a defect in a document that evidences a hypothec, a prior claim, a servitude or a restriction on the right of ownership of property;
(3) a defect in the title to property; or
(4) any other situation affecting title to property or the existence of another real right, including the right to the enjoyment of property.
